1. General information

These terms and conditions apply to all quotes provided by Metro Electrical Services WA to our clients in Australia by accepting our quote you agreed to be bound by these terms and conditions.

 

2. Quote

Our quote is valid for 30 days from the date of issue after which it may be subject to change the quote includes all costs and charges related to the service described in the quote.

 

3. Payment terms

Payment is due in full on completion of work unless otherwise agreed in writing between our business and the client. We reserve the right to charge interest on overdue accounts at the rate of 25% per annum compounding weekly. A deposit of 15% applies to all accepted quotes prior to any project being scheduled in.

 

4. Variations to the quote

We reserve the right to adjust the quote if there are any variations to the scope of work or additional work required that is not included in the original quote, we will provide the client with the revised quote for approval before commencing any additional work.

 

5. Cancellation 

The client may cancel the contract at anytime before work commences provided they give written notice to our business. If the client cancels the contract after the work is commenced the client will be liable for any costs incurred up to the point of cancellation.

 

6. Warranty 

We warrant our workmanship and materials for a period of 12 months from the date of completion of work this warranty covers defects in materials and workmanship only and does not cover damage caused by misuse or neglect.

 

7 Limitations of Liability

To the extent permitted by law our liability for any loss or damage suffered by the client whether arising in contract tort or otherwise is limited to the cost of work carried out by our business.

 

8. Insurance

Our business holds current public liability insurance and workers compensation insurance.

 

9. Work Health and Safety

Our business is committed to ensuring the health and safety of our employees and clients we will comply with all relevant work health and safety legislation and regulations.

 

10. Dispute Resolution

Any disputes arising from this contract will be resolved in accordance with the laws of Australia.

 

11. Governing Law

This contract will be governed by and construed in accordance with the laws of Australia.

 

12. Entire Agreement 

This contract constitutes the entire agreement between our business and the client and supersedes all prior negotiations representations or agreements whether written or oral.

 

13. Severability

If any provision of this contract is held to be invalid or unenforceable the remaining provisions will remain in full force and effect.

 

14. Wavier

The failure of either party to enforce any provision of his contract will not be deemed a waiver of that provision or of the right to enforce that provision.

 

15. Assignment

The client may not assign or transfer their rights or obligation under this contract without prior written consent of our business.

 

16. Notices 

All notices and other communications under this contract must be in writing and sent to the address provided in the quote or to such other address as may be specified by either party in writing.

 

17. Consent for Use

Photography or Videography may be used during and at the completion of works for work records and training. Pictures will not contain any private or specific information pertaining to client or project address. From time to time, Metro Electrical Services WA will use photos or video for use on social media or for online marketing. You can opt out by advising us in writing if you do not want photos or video’s used online.

 

18. Privacy

We may collect personal information such as your name, email address, address, phone number and other contact details when you contact us for a quote or works. We will use this information to communicate with you and may also send you marketing or promotional material that we think may be of interest to you. You can opt out of this at any time by advising us in writing.

19. Promotions

1. Eligibility: The promotional offer is only available to customers who meet the eligibility criteria this may include geographical location age or other factors as determined by the company.

2. Validity: The promotional offer is only valid for a specific period of time as stated in the offer the company reserves the right to withdraw or amend the offer at anytime without prior notice.

3. Exclusions: The promotional offer may not be used in conjunction with any other offer promotion or discount unless otherwise stated the promotional offer may not be applied to certain products or services as determined by the company.

4. Redemption: The promotional offer must be redeemed at the time of purchase the offer can not be redeemed for cash credit or any other form of payment the promotional offer may only be redeemed once per customer.

5. Availability: The promotional offer is subject to availability the company reserves the right to substitute the offer with an alternative of equal or greater value if circumstances beyond its control make it necessary.

6. Termination: The company reserves the right to terminate the promotional offer at anytime if it becomes aware of any fraudulent or other activity which is contrary to these terms and conditions.

7. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the company is located.

8. Disclaimer: The company disclaims all liability for any loss or damage suffered by any person in connexion with the use of the promotional offer including but not limited to any indirect or consequential loss or damage.

9. Refer & Earn: The value of accepted quote must exceed $2000 exc GST and be accept by the client. Should the client accept, a referral name and contact details must be provide to the company for distribution.

10. Acceptance: By using the promotional offer customers accept these terms and conditions.
